I hereby accept an offer made to me by Nurse Assist International (NAI), to enroll in the Outcome Based Assessment (OBA) training course (hereinafter referred to as “the Course”) as indicated in the Letter of Offer (“the Offer”).

  1. Courses

NAI will provide the courses listed below. These courses will be provided online, via audio-visual link, telephone conversations and/or face to face.

All courses must be completed within the time frame given and will be provided by NAI on receipt of the following:

(a) Completed and filled in application form for enrolment; and

(b) AHPRA self-check screenshot. (See the link below)(https://www.nursingmidwiferyboard.gov.au/Accreditation/IQNM/Self-check-and)

∙ Assistance in building a strong professional CV.

∙ Assistance in completing the selection criteria for nursing position available in private and public hospitals.

∙ Coaching on how to address interview questions.

∙ This service is restricted to one job application. More than one job application or position will attract another service fee. This service may take several meetings until the application is submitted.

∙ NAI cannot guarantee a successful job application. This program is designed to provide you with the tools to respond to position criteria and assist with the preparation for any interviews you are awarded.

  1. Fees

(d) Payment of fees on the due dates.

(e) A Letter of Offer will be provided by NAI after the above have been received; and While the program continues, you will be provided with unlimited or ongoing support from the team at NAI.

The two courses are as follows:

  1. Outcome Based Assessment (OBA) – Tuition fee excludes any fee paid to AHPRA and external agencies. 

This is a 11 week intensive training and education package provided by NAI which is inclusive of online NCLEX classes (8 weeks online sessions) andOSCE classes (2 week of online and 1 week of face to face practical demonstrations and assessmentsession).

By signing these terms and conditions you are confirming that you are competent to successfully complete the OBA and comply with the terms and conditions as set out in this document.

  1. Job Readiness-$500 

NAI will support and assist you to create a professional portfolio that will potentially attract an employer. This service will include the following:

The Tuition fees are as follows:

(a) Tuition Fee for OBA is $4,500.00. The payment of this amount is in accordance with the following:

  1. i) NCLEX tuition fee is $1,500payable as: i. $500.00 upfront;

ii.$500.00 by Week 3 of thecourse; and iii. Balance payable by Week 8.

  1. ii) OSCE tuition fee is $3,000.00payable as:
  2. $500.00 upfront;

ii.5% ($1,750.00) payable before the Online sessions; and

iii. 25% ($750.00) payable prior to the final week of face-to- face.

(b) Tuition Fee for Job Readiness is $500.00. This fee is payable prior to arranging assistance with your job application.

The exception is if you have received a letter of offer with a discounted price. In this case, please refer to the letter of offer for the tuition fees payable.

By signing this document, you agree to pay the tuition fees and other charges applicable for your course on the due dates provided and acknowledge and agree that tuition fees may alter from time to time.

Any fee paid to the agents for the course needs to be discussed with the agents.

If you fail to pay your fees on the due date, the following may apply:

(a) Failure to pay your tuition fees may result in suspension from the program, and cancellation of enrolment.

(b) A late payment fee of AUS $100 per month is payable on accounts which remain unpaid 14 days after the due date for payment.

(c) If after commencing the course (OBA, NCLEX or OSCE), you discontinue the course before completion, you remain liable to paythe full tuition fee and any expenses, costs or disbursements incurred by NAI in recovering any outstanding monies, including debt collection agency fees and legal costs.

  1. Cooling Off Period

There is a cooling off period between the date of the Letter of Offer and accepting the Offer by signing these terms and conditions. The cooling off period begins from the date of the “Letter of Offer” and ends at 5.00 pm Australian Eastern Standard Time two (2) business days from the date of the Offer. If during this period, you decide to withdraw from the course you will incur no penalty and any funds paid will be refunded infull.

  1. Attendance requirement

It is a condition of your enrolment that you attend at least 80% of the online classes and 100% of the face-to-face sessions during OSCE.

If you remain inactive for more than 10 days on the website or other course related sites, your access shall be revoked. To reinstate your access, you will have to contact us in writing and seek access again.

Where there is a legitimate reason for non attendance which is acceptable to NAI (such as illness with a doctor’s certificate), you must inform the educator. Not attending online sessions without informing NAI prior to classes, will result in your access being revoked. The same process shall be followed as above for reinstating your access.

If your enrolment terminates due to your lack of attendance or online inactivity, you may not be entitled to any refund of the tuition fees or other charges paid to NAI.

  1. Resources and Materials

(a) All content on the NAI website, and all lessons and material are protected by  Australian and International copyright and other intellectual property laws. You may  not do anything which interferes with or  breaches those laws or the intellectual  property rights in the content. Any unauthorized copying may constitute a breach of these laws.

(b) The resources and materials are provided by NAI exclusively for the purpose of providing education services to students of NAI.

(c) The student may download, view or print a copy of material for personal non commercial use. These resources may not be reproduced, on-sold, published, gifted or otherwise used for any other purpose.

(d) If you are caught misusing the resources and materials your enrolment will be cancelled and no refund provided for any tuition fees paid. This may also impact on your visa requirements and affect any other enrolment or work placement sought by you.

(e) All or any NAI materials supplied to the student must, upon completion of the  course be returned to NAI.

(f) The content on the NAI website will from time to time be altered, deleted or amended without notice. You are responsible for ensuring you access the latest information from the website and remain up-to-date at all times.

  1. Copyright Statement

(a) All resources, materials, and content provided on Moodle are protected by copyright laws and are the intellectual property of Nurse Assist International pty ltd. These resources include but are not limited to lecture notes, presentations, textbooks, videos, audio recordings, and any other study materials available on the platform.

(b) The copyright of these resources remain with Nurse Assist International pty ltd and is protected under applicable copyright laws. Unauthorized copying, distribution, sharing, or any other form of misuse of these resources without explicit permission from Nurse Assist International pty ltd is strictly prohibited.

(c) Students accessing and utilizing the resources on Moodle are granted a limited, non-transferable license solely for their personal use and educational purposes. This license does not permit the sharing, selling,or distribution of the materials to any third party, including other students, individuals, or organizations,without prior written consent from Nurse Assist International pty ltd.

(d) Any unauthorized use, reproduction, distribution, or sharing of the copyrighted materials may result in legal action and may be subject to civil and/or criminal penalties as per the applicable copyright laws.

(e) By accessing and using the resources on Moodle, students acknowledge and agree to comply with the copyright laws, terms, and conditions set forth by Nurse Assist International pty ltd . Any violation of these copyrights may result in disciplinary actions, including but not limited to academic penalties and termination of access to the Moodle platform.

(f) It is the responsibility of each student to ensure the proper use and protection of the copyrighted resources provided on Moodle. If  any student becomes aware of any misuse or unauthorized sharing of the materials, they should immediately report it to the  appropriate authorities at Nurse Assist International pty ltd.

(g) By agreeing to these terms, students affirm that they will respect the copyrights of Nurse Assist International pty ltd and use the  resources on Moodle solely for their personal educational purposes, refraining from any form of unauthorized reproduction, distribution, or sharing with any third party.

(h) Nurse Assist International pty ltd reserves the right to modify or update this copyright statement at anytime without prior notice. It  is the responsibility of students to regularly review this statement to ensure compliance with the latest terms and conditions.

(i) Links to Other Web Sites 

Our Service may contain links to third-party web sites or services that are not owned or controlled by NAI.

NAI has no control over, and assumes no responsibility for, the content, Privacy policies, or practices of any third party web sites or services.

You acknowledge and agree that NAI shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of  or reliance on any such content, goods or services available on or through any such web sites or services.

  1. Privacy Policy & Personal Information

Your privacy is important to NAI.

(a) Your personal information provided at the time of enrolment may be used for:

  • Student administration
  • Student surveys
  • As information for your tutors or teachers.

(b) This information may be required to be provided by law or authorized by law to be disclosed to a third party. (c) You must provide accurate and current contact details to ensure that delivery of the course material is provided to you in a timely and efficient fashion while enrolled at NAI.

(d) NAI will take reasonable online security, technical and organizational precautions to prevent the loss, misuse or alteration.of your personal information and learning provided online.

(e) Any changes, modifications or amendments to this privacy policy will be provided in writing within fourteen (14) days to  your email address and by providing a link on the NAI website.

  1. By enrolling and studying with the Nurse Assist International pty ltd (hereinafter referred to as“NAI”),you agree to the  following terms and conditions:

(a) Conflict of Interest: As a student of NAI, you are not permitted to simultaneously enroll or study with any other  educational institution without prior written consent from NAI. It is considered a conflict of interest to engage in concurrent enrollment or study with another institution while studying at NAI.

(b) Notification Requirement: In the event that you are currently enrolled or studying with another institution or intend to  do so, it is your responsibility to notify NAI at the earliest possible time. You must provide written notification to NAI,  disclosing the details of the other institution and the nature of your enrollment or study. Failure to provide timely and  accurate notification may result in disciplinary actions, including but not limited to academic penalties and termination of enrollment with NAI.

(c) Approval Process: Any request for concurrent enrollment or study with another institution will be reviewed on a case by-case basis by NAI. NAI reserves the right to approve or deny such requests at its sole discretion. Written consent  from NAI must be obtained before commencing any concurrent enrollment or study with any other institution.

(d) Academic Integrity: While studying at NAI, you are expected to prioritize and dedicate sufficient time and effort to your  studies, complying with all academic  requirements and standards set forth by NAI. Engaging in concurrent enrollment or

study with another institution without proper authorization may lead to compromised academic performance and a  breach of NAI’s academic integrity policy.

(e) Disciplinary Actions: Any violation of these terms and conditions may result in disciplinary actions, as deemed  appropriateby NAI. Such actions may include, but are not limited to, academic penalties, suspension, expulsion, and any other.

A refund will be considered only where applicable when the request is in writing. If you do not withdraw during the cooling off period and there are no extenuating circumstances, you will be required to pay the full fee for the course in which you are enrolled.

If you are an overseas student whose visa application is rejected, you must provide the following:

(f) Please confirm rejection of visa in writing; and

(g) Provide certified supporting evidence for the reasons for the rejection of the visa

and NAI will either refund your fees or arrange for you to commence your study with the next intake if the visa application is delayed.

If you choose to enroll in any other institution, your enrolment with NAI will be cancelled and access to resource material revoked. You will be considered a new student if you choose to re-enrol with NAI.

  1. Publicity

You agree that your photographs, videos, or other works, as well as recorded or written testimonials and details of your achievements (“Student Images and Testimonials”) may be used by NAI, or by a third-party agent of NAI, worldwide for promotional purposes including in its printed and online marketing materials and on any social media network without further consent or notification.

If you do not wish to be involved in any kind of publicity referred to above, please provide such notice in writing at the time of  your enrolment.

  1. Cancellation and Refund Policy

If an intake is cancelled by NAI at any time, you have the option of rescheduling to another date or receiving a full refund of the course fee paid. No further monies will be paid for any other expenses you have or may incur including but not limited to such  things as accommodation, travel, equipment etc.

Refund requests must be in writing to NAI. If your refund is approved, the monies will be returned to you by the means in which it  was paid. If the course fee was paid by a third party, the third party will be refunded the course fee.

No refund will be given for any services that have been provided already by NAI including the non- completion of a course without a valid reason.

If you are not able to complete the course, you are not entitled to a refund unless you are unable to complete the course due to circumstances beyond your control in which case a partial refund may be available. Evidence will need to be provided to confirm the circumstances which caused your inability to complete. This will be at the discretion of NAI as to whether a refund applies in your particular circumstances.

If you decide to discontinue the training package after commencement due to no fault of NAI or NAI decides to cease the service to you on the grounds you have not complied with the terms and conditions listed in this agreement, there will be no refund paid by NAI. If you decide to join the next intake, you will have to rebook the course at Full Fee.

  1. Disputes

If a dispute arises, both parties agree that confidentiality is paramount to the reputation of both parties. The parties to a dispute agree to the following:

(a) All communications, discussions and resolutions will be conducted privately and remain confidential. (b) Any publication of the communications, discussions or resolution will be considered a breach of the agreement; (c) Any published material that is considered defamatory, negative or damaging may be the subject of compensation through mediation or litigation.

(d) If the dispute concerns the content of the Course or any aspect of these Terms and Conditions the parties agree to obtain an independent professional arbiter to make a determination. In this case, the parties agree to meet their own legal costs.

  1. Governing Law 

These terms are governed by the laws of New South Wales and the Commonwealth of Australia where applicable.

I agree that I will abide by the terms and conditions of enrolment included in this Agreement: 

  1. I confirm that the terms and conditions of the Offer have been read and understood by me.
  2. By studying with NAI, you acknowledge and agree to abide by these terms and conditions regarding concurrent enrollment or study with other institutions. You understand the importance of avoiding conflicts of interest and the obligation to notify NAI of any  such engagements.
  3. I have read, understood and agreed to the terms of the Cancellation and Refund Policy outlined in this document. 4. I acknowledge that I have been informed about, or provided information on, the protection of personal information I provide to NAI, including health information.
  4. I have received an email about, or have been provided with information on the following:
  5. The entry requirements for admission into the course, including level of English language required and academic qualifications required, course duration and content, and information about training and assessment methods;
  6. The facilities, classroom equipment and learning resources.
  7. The grounds on which the enrolment may be deferred,suspended or cancelled, and
  8. Accept any conditions set out in the Letter of Offer.
  9. I acknowledge that I have reviewed the cost-of-living expenses and the estimated total cost for tuition fees and other charges and acknowledge I have, or will have, the financial capacity to complete my course of study.
  10. I understand that I cannot hold NAI, an education provider that educates and trains me for OBA, responsible for my nursing registration with AHPRA.
